Terms And Conditions

  1. Introduction

This Agreement is between My Online Schooling (“we/us”) and you, the parents or guardians (“you/parents”) of your child (“the pupil”). The Agreement stipulates the terms and conditions upon which a place has been offered to the pupil. Once you have accepted a place for your child you are agreeing to be legally bound by these terms and conditions.

We ask that you read the terms and conditions carefully before submitting your enrolment application to us.

  1. Acceptance and Enrolment

A place in a course is accepted by you for a pupil by paying the non-refundable enrolment fee and first monthly, termly or annual fees payable in respect of the proposed enrolment and returning required enrolment documentation. This is subject to our acceptance of the enrolment which will be deemed to exist when we convey our acceptance by email.

  1. Duration

The agreement will remain in force until the pupil concludes their education with My Online Schooling or is either voluntarily withdrawn by parents by completing a leaving form or excluded by way of authority granted by these terms and conditions.

  1. Provision of Education

My Online Schooling shall endeavour to do all that is reasonable to provide a suitable educational environment for every pupil. We cannot guarantee that the pupil will achieve his or her desired examination results or that their results will be sufficient to gain entry to other educational establishments.

My Online Schooling does not currently handle the administration of examinations. Pupils are required to register as a private candidate. Finding a suitable examination centre, the meeting of deadlines for registration and costs incurred by taking the examinations are the responsibility of the parents. Additionally, the requirements for participation in other required educational provisions i.e. practical science for A-level, are the responsibility of the parents.

  1. Age Eligibility

For reasons of child protection and safeguarding, My Online Schooling cannot accept individuals to classes if they are over 18 years of age. Please view our Safeguarding Policy for further information.

  1. Timetables

Pupil timetables are created by My Online Schooling before the pupil’s intake date. Timetables are created to maintain small class sizes. If a prospective family has timetable constraints, they can submit a timetable request to the My Online Schooling Administration Team. My Online Schooling will endeavour to accommodate timetable requests, but there is no guarantee that requests will be met.

Timetables are designed to ensure there are no clashes within each year group. My Online Schooling will endeavour to prevent clashes within the timetable; however, if a family chooses to enrol in multiple year groups, My Online Schooling cannot guarantee that clashes will not occur.

The timetable is subject to change.

  1. Fees

All fees and other expenses payable are set out on the My Online Schooling website.

non-refundable $600 AUD enrolment fee is payable by you if your pupil is enrolled in My Online Schooling Asia Pacific. The enrolment fee must be paid before students get access to the school. The enrolment fee is applicable to all pupils joining the school, even if they have been previously enrolled.

If paying termly/yearly and starting part way through the term/year, tuition fees for the first term/year of enrolment will be calculated on a prorated basis.

Monthly fees are to be paid by Direct Debit (AU bank accounts only) or bank transfers every month, over 11 months – there are no fees payable over the summer holidays. The first and final month will be calculated on a pro-rata basis.

Monthly, termly and yearly invoices are due no later than the intake date as agreed upon in the required enrolment documentation.

Fees of a pupil which have not been paid in full or agreed through a payment plan before the intake date may be excluded until the necessary amount is paid. Liability to pay fees is joint and several as between parents or guardians. You are liable to pay the fees and any other additional expenses associated with your child’s enrolment and continuing education with us, including the expenses and legal costs of recovery of unpaid fees where incurred.

We will seek to keep fees stable but reserve the right to increase fees at any time with at least 30 days’ prior notice. You agree to pay those fees on receipt of notice of any such increase.

No refunds will be given for minor disruptions to the provision of lessons.

Changing Method of Payment

Changes to your payment option can be made on a term-to-term basis. If you would like to change your method of payment, we will require at least 28 day’s notice prior to the end of the previous term. This only applies to monthly and termly payment frequencies.

Incompletion of Agreed Payment(s)

If a payment has not been paid on the agreed date and without 7 days’ prior notice, access to all classes and resources will be suspended immediately until the payment is made. If no efforts are made to contact My Online Schooling and make the payment, it will be passed to our debt collection agency.

You risk losing your place if enrolment and any tuition fees are not paid on the agreed payment date.

  1. Termination

Notice to leave the school must be done in writing by completing the Leaving Form on the parent portal and giving us the notice set out below.

We may suspend the services we provide or terminate the pupil’s participation in any course or terminate this Agreement by giving you 14 days’ notice of our intention to do so where you have failed to pay the fees when due or to comply with these terms and conditions, or the pupil has failed to comply with appropriate standards of behaviour.

Monthly Payments

If you are on a monthly payment plan and decide to leave us, your exit date will be the end of the month provided that you have notified us by the 15th of the month. If you notify us after the 15th, your exit date will be the end of the following month. Your Direct Debit payment (AU bank accounts only) will be cancelled on or before the cut-off date when notified of your intent to leave. Invoices for the month following the exit date will not be issued. Please note that we do not offer any refunds for any lessons not attended.

Termly Payments

If you are on a termly payment plan, you must notify us at least 28 days prior to the end of term if you wish to leave. Termly payments are paid in advance of term commencing and they are non-refundable. Full payment must be made within 14 days prior to term starting.

Yearly Payments

If you pay yearly, you will not be entitled to a refund of payments during that academic year. If you do not wish to continue with us beyond the end of the year, you must notify us in writing 28 days prior to the academic year finishing. Full payment must be made within 14 days prior to the academic year starting.

Failed Payments

If on 3 occasions, a payment is not made by the agreed date and without 7 days prior notice, My Online Schooling has the right to permanently remove the pupil from the school. If you wish to re-enrol, you will be liable to pay the full amount of the enrolment fee again

  1. Internet Security

We will take all reasonable steps to ensure that your child uses the facilities of the school platform for appropriate purposes, but your child will be held accountable for any misuse. Deliberate misuse will be treated as a breach of My Online Schooling rules.

Pupils will use YouTube and other resources from the internet as part of their lessons. The school will never direct anyone to anything that is not educational. It is the parents’ responsibility to ensure that they have appropriate content controls and internet security software to protect their child from inappropriate online content.

We cannot always guarantee that international pupils will be able to access UK content online.

  1. Usernames and Passwords

Pupils must not share links or logins with other pupils. If pupils wish to find each other outside our system, they will have to go through the office and the other pupil’s parents.

  1. Study Environment

Parents are responsible for ensuring their child has access to an appropriate location from which to study. My Online Schooling is not responsible for the home (or any other) study environment. It is the responsibility of pupils, parents and carers to read the School Handbook and ensure that any additional materials such as textbooks are purchased as required.

Parents are responsible for ensuring that their child attends lessons. Parents must also ensure that their child has access to the internet and the correct technology to take part in lessons. The computer and software requirements are set out in the School Handbook which can be found on the parent portal. Refunds will not be given for poor internet connection or if there are issues with the device that the pupil is using.

If pupils are unable to attend a live lesson a parent or carer must notify the school using the absence form. If a pupil misses a live lesson, they are expected to watch the recording of that lesson at a later date.  If a pupil misses a lesson because of an individual issue then they are expected to watch the lesson recording.

Users of My Online Schooling are pupils who are home-schooled or those who are using the service to supplement full-time education in a regular school. As such, the full responsibility of the provision of their education lies with parents or caregivers. Parents of pupils who do not attend regular, full-time school are responsible for ensuring the legality of home-schooling in their country.

  1. Cancellation of Lessons

Lessons that are cancelled due to the fault of the school (e.g. teacher connection, system break down, staff illness) will either be covered by a supply teacher or made up in the form of cover work or recorded lessons. My Online Schooling does not offer refunds for cancelled lessons that are supplied with one of the provisions listed above.

In order to continue the provision of lessons, My Online Schooling reserves the right to make changes to the timetable.

  1. Behaviour and Authority of the Education Manager

You authorise the Education Manager of My Online Schooling, or their nominated deputy, to take such action as the Education Manager may consider being in the best interests of the pupil on a day to day basis. The Education Manager has authority to deal with all disciplinary matters arising and to delegate disciplinary powers amongst the staff as he or she considers appropriate. Parents and pupils accept such authority unconditionally.

Parents and pupils are responsible for adhering to the school’s Behaviour Policy, as amended from time to time, which is available on the My Online Schooling website.

The Education Manager reserves the right to exclude pupils as a result of the poor behaviour of the pupil or inappropriate or abusive behaviour of the parent.

  1. Confidentiality

We will only disclose confidential information that we receive by reason of this Agreement where required to by law, where it is otherwise in the public domain, or where necessary to give effect to the terms of this Agreement.

  1. Privacy and Data Protection

“Personal Information,” as defined in the Privacy Act 1988 (Cth) will only be used by us to provide you with the services under this Agreement in accordance with all Privacy Principles which govern the handling of such information by us including, without limitation, the Australian Privacy Principles under the Privacy Act. We understand the importance of pupil privacy and we will use our best endeavours to ensure that any publication, including photographs, videos and other posts by My Online Schooling on our website or on social media will be in the best interests of pupils and will not be posted without parental consent.

We will use the information you provide to us relating to you and your child, together with other information, for administrative monitoring, accounting, planning and control of the curriculum and examinations, publication of examination results, provision of references, analysis for education and management purposes and other purposes necessary for the good management of the school and the welfare of its staff and pupils. We may disclose some or all of this information to service providers and agents for these purposes.

You agree and consent to our processing of the information and you and your child provide to us for the purposes outlined above which shall include, where necessary, the processing of sensitive data which is that relating to your child’s health, their religious denomination and ethnic or racial origin.

My Online Schooling has a policy of recording all academic lessons. This policy is believed to be in the best interest of all pupils and teachers as well as parents. All lesson recordings remain securely on our software provider’s servers.

All lesson recordings are property of My Online Schooling. You are prohibited from sharing or distributing recordings in any capacity.

Parents give My Online Schooling permission to contact any exam centres where a pupil has sat exams and request the exam results be released to My Online Schooling.

  1. Limitation of Liability

To the extent permitted by law, any liability to you or the pupil in contract, tort, statute or in any other way for any injury, loss or damage of any kind whatever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage), sustained by the pupil, you or any other person, or for any other costs, charges or expenses incurred by you arising from or in connection with this Agreement, and any act or omission of My Online Schooling, its agents or employees is excluded.

To the extent permitted by law, you indemnify us in respect of any loss or liability suffered by us arising from this Agreement by reason of your breach.

  1. Election of school

We reserve the right to select which school the pupil is enrolled into, either My Online Schooling UK or My Online Schooling Asia Pacific. This selection is dependent upon the pupils current location/region in the world.

  1. Changing Enrolment

If you choose to add a subject, please complete the Add Subjects form on the parent portal. Additional subjects will only be actioned via this form. Requests made via the form by the 15th of the month will take effect the at the end of that month. Changes requested after the 15th will take place at the end of the following month. Tuition fees will be updated accordingly. All requests will be subject to class availability.

Once the Add Subjects form has been submitted, you will be liable for any payments incurred by the changes requested on the form.

Dropping a subject

If you wish to drop subjects, this can be done on a termly basis only. You must request at least 28 days prior to the end of term and the changes will take effect for the new term. Term dates can be found on our website.

If you wish to drop a subject, you will need to submit the ‘Drop Subject’ form in the parent portal. There is a $20 AUD administration fee for dropping a subject.

Once the Drop Subjects form has been submitted, you will be liable for any payments incurred by the changes requested on the form. No refunds will be provided for tuition fees already paid.

Opting Out of the Health and Wellbeing Support Package

Opting out of the Health and Wellbeing Support Package can be done on a monthly or termly basis, depending on your billing cycle. If you are on a monthly payment plan and wish to opt out of the support package, this will take effect the following month, provided that you have notified us on or before the 15th of the month. If you notify us after the 15th, it will take effect at the end of the following month. Payment information will be changed accordingly.

If you are on a Termly or Yearly payment plan, you may opt out of the package at the end of each term provided that you have notified us at least 28 days prior to the end of term.

  1. Variation

Except as stated in this Agreement, this Agreement may only be varied by agreement or by My Online Schooling giving at least 14 days’ notice to you of the changes, including if applicable, the new amount, new frequency of payment and next debit date in respect of any payment.

  1. Entire agreement

This Agreement, together with any documentation accepted by us on enrolment to facilitate payment of fees and material to which reference is made in clauses 8 and 19, constitutes the entire agreement between the parties and supersedes all prior representations, agreements, statements and understandings, whether verbal or in writing.
